The ATO has vast and invasive powers to recover outstanding tax debts from taxpayers and company directors.
Those powers include recovery proceedings in court, freezing assets, orders to garnish accounts or prevent individuals from leaving Australia, and even initiating insolvency processes. Armed with these powers, the ATO is responsible for collecting what is owed and is actively pursuing outstanding debts – whether contested or uncontested.
Appropriately dealing with contested tax debts is an integral part of managing any tax dispute to allow taxpayers to continue their business and prosecute their case.
In 2023, Arnold Bloch Leibler partner Shaun Cartoon, and senior associate Andrew Spierings prepared a paper covering the recent developments in this space for The Tax Institute’s Private Business Tax Retreat. View the paper below.
