In the matter of Timbercorp Securities Limited (in liquidation) (ACN 092 311 469) and the Managed Investment Schemes set out in Schedule 1

On 16 December 2025, the Liquidators of Timbercorp Securities Limited (in liquidation) (ACN 092 311 469) (TSL) applied to the Supreme Court of Victoria seeking orders relating to the distribution of net proceeds from:

(a)    the harvest and sale of certain assets of some Schemes;
(b)    the sale of those assets; and
(c)    proceeds held on Grower investors’ behalf pursuant to deeds of compromise entered into between TSL and representative Growers (amongst other parties).

Timbercorp Finance Pty Ltd (in liquidation) (ACN 054 581 190) (TFPL) makes claims over certain proceeds where relevant Growers have loans that remain unpaid to TFPL.

The proceeding was listed for a directions hearing on Friday 30 January 2026 before Associate Justice Gobbo (Directions Hearing). 

TFPL filed a notice of appearance in the proceeding. TSL proposed draft orders which TFPL agreed to. The Court made orders on the papers on 30 January 2026 without attendance from the parties at the Directions Hearing (January Orders). The January Orders were varied by orders made on 12 March 2026 (March Orders).

The Orders include orders for the following:

1. The proceeding is listed for final hearing at 10:30am on 1 April 2026.
2. TFPL has been granted leave to be heard in the proceeding.
3. By 4:00pm on 11 February 2026, any member in the schemes set out in the Schedule who seeks leave to be heard, is to file and serve an application for leave to be heard.
4. By 4:00pm on 13 February 2026, any member in the schemes set out in the Schedule who seeks leave to be heard is to file and serve any affidavit it intends to rely.
5. By 4:00pm on 12 and 16 March 2026, TFPL is to file and serve substantive and supplementary affidavits respectively.
6.  By 4:00pm on 23 March 2026, TFPL and any member in the schemes set out in the Schedule who seeks leave to be heard is to file and serve a written outline of submissions.
