The hearing of allegations brought by the ACCC against the Tasmanian Ports Corporation (TasPorts) has been scheduled to commence in the Federal Court in April next year. As reported in the Launceston Examiner, the ACCC instigated court proceedings against TasPorts in late 2019 for alleged misconduct under the amended misuse of market power provision.
It is the first case instigated by the ACCC under the controversial law, which was passed after heated national debate in 2017.
The ACCC alleges that TasPorts sought to stop a new entrant from competing with its marine pilotage and towage businesses.
The Examiner reports that TasPorts intends to vigorously defend the proceedings, and has engaged Arnold Bloch Leibler competition partner Matthew Lees and senior counsel in Rowena Orr QC.
