About Gisella

Gisella D’Costa is a Senior Associate in Arnold Bloch Leibler’s Workplace Advisory group.

She has over 15 years’ experience providing advice on all aspects of the employment relationship and workplace relations, with a particular specialisation in advising on the employment aspects of major workplace changes including restructures, redundancies, mergers and acquisitions and outsourcing.

Gisella enjoys working with her clients to formulate practical solutions for dealing with workplace disputes and to develop and implement strategies to reduce the risk of disputes in the workplace.  She has been a trusted adviser to many clients during her years of practice.

Gisella holds a Bachelor of Commerce and a Bachelor of Laws with honours from Monash University.

Practice focus

Gisella’s practice spans a range of workplace issues, including:

  • strategic workplace planning and change management
  • employment implications of business restructures, outsourcings and acquisitions
  • protection of confidential information and intellectual property
  • senior executive engagements, transitions and separations
  • disciplinary, performance management and termination of employment advice

  • a security solutions company: in relation to litigation in the Federal Court of Australia concerning allegations of adverse action
  • a large professional body: in relation to its casual workforce including award classification and entitlements and conversion to permanent employment
  • a large travel group: in relation to the proposed outsourcing of its labour force 
  • a range of custom brokers and freight forwarders: in relation to employment contracts, employee entitlements, termination of employment, unfair dismissal claims and post-employment restraints and obligations
  • an international design and manufacturing company: in relation to litigation in the County Court of Victoria concerning allegations of breach of contract and misleading and deceptive conduct
  • various real estate groups and agencies: in relation to employment contracts, award entitlements, restructures and redundancies, unfair dismissal claims, general protection claims, underpayment claims and enforceability of post-employment obligations
  • a commercial laundry services provider: in relation to an independent contractor claim in the County Court of Victoria
  • an emergency services provider and a women’s health organisation: both in relation to proposed enterprise agreements and agreement making process, and
  • a large professional association: in relation to the characterisation of its contractors and contractor entitlements.
