About Claire

Claire Stubbe is a Senior Advisor in the firm’s dispute resolution & litigation practice. She has a particular focus on commercial litigation, corporate governance issues, reconstruction and insolvency and corporate regulatory investigations. Claire acts for public and private companies as well as high-net-worth individuals.

Claire graduated from the University of Melbourne with a Bachelor of Arts (Media & Communications) and a Bachelor of Laws in 2010. After graduating, Claire worked with the World Health Organisation in Geneva, Switzerland as a Legal Intern. Claire joined Arnold Bloch Leibler in 2011 and was admitted to practice in 2012.

During 2014 and 2015 Claire worked as an Associate to the Honourable Justice Elliott of the Supreme Court of Victoria, where she was involved in both commercial and criminal cases. Claire returned to Arnold Bloch Leibler in 2015 and was appointed as a senior associate in 2016 (effective 1 July). Claire is currently on a leave of absence.

Practice focus

Claire’s practice focuses on the following areas:

  • commercial litigation and alternative dispute resolution;
  • corporate governance issues, including director and shareholder disputes;
  • corporate reconstruction and insolvency;
  • corporate regulatory and criminal investigations; and
  • contractual, trusts and trade practices dispute.

Experience

Claire has acted for international and domestic clients in a range of matters including:

  • Directors of public and private companies: regarding corporate governance issues, directors’ duties claims, misleading or deceptive conduct, accessorial liability claims, contractual disputes and guarantee claims, including in various Supreme, Federal and Appellate Court proceedings;
  • Shareholders of private companies: regarding rights and remedies, including in the context of oppression proceedings and derivative actions in various Court proceedings;
  • Public and private company groups: regarding distressed subsidiaries, including advising in relation to corporate reconstruction and insolvency administrations (schemes of arrangement, receiverships, voluntary administration, deeds of company arrangement and liquidation) and associated Court proceedings;
  • Public and private companies: in relation to internal investigations and corporate regulatory investigations, including investigations by the Australian Securities and Investments Commission and the Australian Stock Exchange regarding breaches of the Corporations Act and Listing Rules as well investigations by the Australian Federal Police in relation to white collar crime;
  • A variety of corporate and individual clients: regarding general contractual disputes, joint venture disputes, partnership disputes and trusts disputes, including in the context of Court proceedings and alternative dispute resolution processes (arbitration, expert determination and mediation); and
  • High-net-worth individuals: regarding dissemination of personal and confidential information and images, including advising in relation to breaches of confidence and associated criminal offences.
