| 28 Feb | Case note: Court sweeps aside unconscionable conduct claims against sales representatives Australian Competition and Consumer Commission v Lux Distributors Pty Ltd [2013] FCA 47 This case note looks at the recent decision by Justice Jessup in the Federal Court in Australian Competition and Consumer Commission v Lux Distributors Pty Ltd [2013] FCA 47. Justice Jessup dismissed the ACCC’s claims against Lux Distributors Pty Ltd, which had sold domestic vacuum cleaners to five elderly women via door-to-door sales representatives. | 19 Feb | Taxation bulletin: Loss carry-back rules On Wednesday 13 February 2013, the Federal Government introduced legislation into Parliament to allow the limited carry-back of corporate losses. Under the current law, a company that makes a profit in one year and a loss in the next year pays a higher effective tax rate over the two-year period than another company that makes the same overall profit in a more even fashion. The loss carry-back rules seek to reduce some of this asymmetry and replicate similar rules already present in other jurisdictions. (PDF format 213Kb) | |
