| | 23 Jan | Taxation bulletin: Prescribed Private Funds – A response to proposed changes to PPFs In the May 2008 Federal Budget, the Treasurer announced that the government will legislate guidelines to improve the integrity of Prescribed Private Funds (PPFs) and provide the trustees of PPFs with greater certainty as to their philanthropic obligations, with effect from 1 July 2009.
In late November 2008, Treasury released a Discussion Paper entitled Improving the integrity of Prescribed Private Funds and invited the public to comment on the proposed measures.

In a decision handed down on Friday 12 December, the Federal Court has, effectively, overturned the accepted understanding of how the GST rules apply to taxable supplies made by 'representatives of incapacitated entities', including a trustee in bankruptcy, liquidators, receivers and administrators. If the decision in Deputy Commissioner of Taxation v PM Developments Pty Ltd stands, it will effectively advantage secured creditors over the Australian Taxation Office (ATO) in relation to post insolvency GST liabilities.
