Jonathan Milner is a partner of the firm’s dispute resolution & litigation and reconstruction & insolvency practice groups in Sydney. He has been involved in some of Australia’s largest and most public commercial matters, including a range of corporate regulatory inquiries and investigations and white collar crime.

Jonathan graduated from The University of New South Wales in 1999, and was admitted to practise as a solicitor of the Supreme Court of NSW and the High Court of Australia. He joined Arnold Bloch Leibler in 2006 and was appointed as a partner in 2009. Prior to joining Arnold Bloch Leibler, Jonathan was a senior associate at the firm now known as Herbert Smith Freehills.

  • corporate recovery and insolvency.

Experience

Jonathan has acted for a wide variety of corporate and private clients, including:

  • a senior member of the Australian government: in relation to an ICAC investigation and hearing;
  • the former CEO of ABC Learning: in relation to criminal proceedings commenced by the Commonwealth Director of Public Prosecutions;
  • a non-executive director of James Hardie: in relation to civil penalty proceedings in the Supreme Court of NSW, the NSW Court of Appeal and the High Court of Australia;
  • a director of Allco Finance Group: in relation to investigations by ASIC and litigation commenced by the receivers and managers of Allco;
  • the financial guarantors of the Reliance Rail/Waratah trains project: in relation to the restructure of that project and associated litigation in the NSW Supreme Court;
  • the estate of the late Richard Pratt: in relation to proceedings commenced by Madison Ashton in the Supreme Court of NSW;
  • Steven Hui Xiao, the former managing director of Hanlong Mining Limited: in relation to ASIC’s investigation into insider trading by the executives of Hanlong Mining;
  • a senior executive: in relation to ASIC investigations concerning the Everest Financial Group;
  • a former senior executive of Aston Resources: in relation to a contractual claim against Aston Resources in the Supreme Court of NSW;
  • Newmont Mining Corporation: in relation to legal proceedings arising out of the restructure of Newmont’s Australian operations;
  • Specialty Fashion Group: in relation to a dispute arising out of the sale of its discount variety business and in relation to Court proceedings concerning the fraudulent misappropriation of funds by a senior executive;
  • Telstra: in relation to the liquidation of One.Tel; Tricom: in relation to the workout of its margin lending business;
  • DP World Australia: in litigation concerning access to port facilities;
  • Challenger Group: in Supreme Court of NSW litigation arising out of Challenger’s investment in an Australian equities fund; and
  • Sons of Gwalia creditors’ committee: in relation to the administration of Sons of Gwalia.

Jonathan has also acted for clients in a range of regulatory investigations and white-collar crime litigation, including a number of high profile insider trading investigations and associated litigation. He also regularly advises directors, banks and financial institutions.

Jonathan has acted for a range of other corporate entities, including the Australian Rugby Union, Breville Group and various US hedge funds, in relation to a wide variety of matters.
